Terms of Service

By booking or using any service provided by FOAM'D ("we", "us", "our"), you agree to the following terms and conditions. Please read them carefully.

1. Services

FOAM'D Auto Care (registered as FOAMD) provides mobile car detailing, ceramic coating, graphene coating, interior detailing, pre-sale detailing, automotive photography, and related services across Sydney and Wollongong, New South Wales, Australia.

All services are performed at your nominated location. It is your responsibility to ensure adequate access, a level surface where practicable, power supply (where required), water supply, and a suitable working environment at the time of your booking. If these conditions cannot be met on arrival, FOAM'D reserves the right to reschedule the booking and a callout fee may apply.

Service descriptions on our website are indicative of typical outcomes. Final scope may be adjusted based on the actual condition of your vehicle at the time of service. We will always communicate any material changes before proceeding and will not commence additional work without your approval.

FOAM'D reserves the right to decline or discontinue any service if, in our professional judgement, the condition of the vehicle, working environment, or other circumstances make it unsafe or impractical to proceed.

2. Bookings & Scheduling

Bookings can be made through our online booking system or by contacting us directly. A booking is confirmed only once you receive written confirmation from FOAM'D.

A deposit may be required at the time of booking for coating services (ceramic, graphene). The deposit amount will be communicated at the time of booking and is deducted from your final invoice. Deposits are non-refundable except where FOAM'D initiates the cancellation.

We reserve the right to reschedule bookings due to adverse weather conditions, equipment issues, or other circumstances outside our reasonable control (including but not limited to severe weather, natural disasters, or public health directives). In such cases, we will provide as much notice as possible and offer an alternative date at no additional cost.

If you need to reschedule, please notify us at least 48 hours before your scheduled booking.

Cancellations made with less than 24 hours notice, or where you are unavailable at the nominated location at the agreed time, may incur a cancellation fee. Any deposit paid may be forfeited.

3. Pricing & Payment

All prices are listed in Australian dollars (AUD) and are inclusive of GST where applicable.

Coating service prices (ceramic and graphene packages) are fixed as displayed on our website at the time of booking. Detailing services — including interior detailing, pre-sale detailing, and maintenance packages — are quoted individually based on vehicle size, condition, and complexity prior to commencement. No detailing work will begin without your prior written or verbal acceptance of the quoted price.

Payment is due in full on completion of service unless otherwise agreed in writing in advance. We accept cash, major debit and credit cards, and bank transfer (EFT). Card payments may incur a merchant surcharge.

Where a deposit has been paid, the balance is due on the day of service upon satisfactory completion. FOAM'D reserves the right to withhold keys or access until payment is received in full.

Add-on services — including wheel coating, glass coating, and interior coating protection — are priced separately and must be agreed upon before the service date.

Prices displayed on our website are subject to change. The price applicable to your booking is the price confirmed in your written booking confirmation.

4. Your Vehicle

By booking a service, you confirm that you are the registered owner of the vehicle, or that you hold the explicit authority of the registered owner to authorise the service.

You agree to disclose any known pre-existing damage, paint defects, prior paintwork, modifications, or conditions that may be relevant to the service before work commences. Failure to disclose known pre-existing issues may affect the outcome of the service and may limit our liability.

FOAM'D takes reasonable and professional care of your vehicle at all times. We hold public liability insurance. In the event of accidental damage caused directly by FOAM'D during the service, we will assess the situation promptly and work toward a fair resolution, which may include repair or reasonable compensation.

We are not liable for pre-existing paint defects, swirl marks, scratches, chips, clear coat failure, rust, oxidation, or any damage that was present before the service commenced or is revealed during the decontamination, correction, or preparation process.

FOAM'D is not liable for any mechanical, electrical, or structural issues arising during or after detailing services where such issues are unrelated to the service performed. We recommend that all loose personal items are removed from the vehicle prior to the appointment.

5. Coating Warranties

Prizm coating warranties — 3, 5, 7, or 10 years depending on the package selected — are provided by the coating manufacturer (Prizm) and are subject to the manufacturer's own warranty terms and conditions, which will be supplied to you at the time of service.

To maintain warranty validity, you must: use pH-neutral wash products and the two-bucket wash method (or a touchless wash), avoid automated car washes with brushes or rollers, attend scheduled FOAM'D maintenance inspections as recommended, and promptly report any coating defects to FOAM'D in writing.

Warranty claims must be submitted to FOAM'D in writing via our contact page or by email. We will assess the claim and liaise with the manufacturer on your behalf. We aim to respond to warranty claims within 5 business days.

Warranties are non-transferable and apply to the vehicle and coating package as serviced. Warranties are void if the vehicle has been involved in a collision requiring panel repairs, subjected to paint correction or polishing by a third party after coating, or the coating has been contaminated by industrial chemicals, strong acids, or alkaline products.

Warranties do not cover paint damage, stone chips, accident damage, clear coat delamination, or degradation caused by improper washing, unauthorised modification, environmental fallout, or neglect.

FOAM'D provides a separate craftsmanship guarantee on the application of all coatings. If a coating defect attributable to improper application is identified within 30 days of service, we will rectify it at no charge.

6. Limitation of Liability

To the fullest extent permitted by Australian law, FOAM'D's total aggregate liability for any claim arising from or related to our services is limited to the total price paid by you for the specific service giving rise to the claim.

FOAM'D is not liable for any indirect, consequential, incidental, special, or punitive losses, including but not limited to loss of use of the vehicle, loss of income or earnings, cost of alternative transportation, or diminished resale value, arising from our services or any delay in performing them.

FOAM'D is not responsible for losses or damage arising from circumstances beyond our reasonable control, including adverse weather, acts of God, supply chain disruptions, or third-party service failures.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, warranty, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted, or modified.

FOAM'D reserves the right to refuse or discontinue service where the working environment is unsafe, access conditions are not met, or where conduct toward our team is unreasonable.

9. Disputes & Resolution

If you are dissatisfied with any aspect of our service, please contact us promptly so we have the opportunity to make it right. We ask that you allow us to inspect any alleged defect before engaging a third party. If a dispute cannot be resolved between the parties, either party may refer the matter to NSW Fair Trading.

FOAM'D collects and handles personal information in accordance with our Privacy Policy, available at foamd.com.au/privacy.

By booking our services, you consent to FOAM'D collecting and using your personal information as described in our Privacy Policy, including for service confirmations, appointment reminders, and follow-up communications.

11. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, business practices, or applicable law. The current version will always be published on this page with the date of last update.

For bookings made prior to an update, the terms in effect at the time of booking will apply unless you expressly agree to the updated terms.

Continued use of our services after any update constitutes your acceptance of the revised terms.

12. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes that cannot be resolved by agreement or mediation will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
